Agricultural value assessments ~ Soilgroup Worksheet

A soilgroup worksheet lists the soil types that you have on your property. It tells how many acres of each soils group that you have in  production (farmed) only. Your Town Assessor will use this worksheet, along with the application to help determine your tax exemption.

What information do I need to request a worksheet ?

THIS INFORMATION IS NEEDED FOR EACH PARCEL !

  • Copy of your current Tax Bill
  • DCSWCD Request form COMPLETELY filled out.
  • Pre Pay $40.00 per parcel number.

When should I file my agricultural exemption?

Agricultural exemptions can be filed at any time of the year but are due for the current year of filing by March 1.  If you know you will be filing for an agricultural exemption on property in Dutchess County, you will need to contact the Dutchess County Soil and Water Conservation District office for a Soil Group worksheet.  These worksheets are done in our office on the computer and are completed as rapidly as possible.  Please allow at least 1-2  weeks for your worksheet to be completed. 

 How do I contact the District office?

We can be reached by phone at 677-8011, ext 3.  We can no longer accept faxed requests due to our new policy of payment must be made with request.  Mail it or come by and see us at 2715 Route 44, Suite 3, Farm and Home Center, Millbrook, NY  12545.

 Does the District office file the worksheet?

No.  We do not file these worksheets with the assessor.  That is up to the landowner or their agent.  The worksheets require a landowner signature and the signature of the preparer.  We sign them as the preparer and will mail them to you if requested to do so.  Otherwise, our policy is to call you when the worksheet is done and you may pick it up in our office.  Payment is expected at the time of the request.

 Can I pick it up on Saturday?

No.  Our office hours are Monday-Friday, 8:00 a.m. to 4:30 p.m.

What is the fee for the worksheet?

Currently, our fee is $40.00 per parcel.  This is subject to change, so please verify your bill with us before you write your check.

 Can I pay by credit card? 

No.  We do not have a way of processing credit cards.

 Is that all there is to filing for an agricultural exemption?

You will need to have a form known as RP-305 if you are filing for the first time or a 305R if you are renewing your ag exemption.  You must turn in this form each time you apply for your ag exemption.  You can get this form from your town’s assessor or it can be downloaded from the web.  For more information on filing an Agricultural Exemption, go to the following web site http://www.orps.state.ny.us/ref/forms/index.htm

What if my property is not included in an Ag District?

Filing for an Ag Exemption on your property taxes does not automatically mean the property is included in an Agricultural District.  You may file what is known as an Individual Commitment. 

 What’s the difference?

If you are included in an Ag District, your farming operation is protected by the New York State Ag and Markets right-to-farm laws.  If you are outside of an Ag District, the town in which your property is located will rule.  Each town has a variation of what is required for a business (yes, if you farm you are a business), and you will be responsible for complying with all town rules and regulations.

  How do I get my property included in the Ag District? 

If you feel that your property should be included in an Agricultural District you will need to file a request form with the Dutchess County Soil and Water during the annual sign up period.  This specific time period is set by the Dutchess County Legislature for annual enrollments.  This time period is the only time you can enroll a parcel into the Ag District.  Check this website for a form or give us a call at 845-677-8011, ext 3.
