MS4, Where Are You?

 

 There is a lot of confusion about what an MS4 actually is, let alone whether you qualify to be regulated under the new rules or not.  A municipal separate storm sewer system (MS4) is any conveyance or system of conveyances (including ditches, storm sewers, roads, gutters, channels or storm drains) that are:

  •  Designed to carry stormwater,

  •  Owned or operated by a public entity,

  •  Is not part of a combined sewer, and

  •  Is not part of a Publicly Owned Treatment Works (POTW). 

Under Phase II, there are three types of regulated MS4s:

  •  MS4s that lie in an “urbanized area” (as designated by the U.S. Census),

  •  MS4s designated as having a potential for adverse impacts on water quality, and

  •  MS4s outside an “urbanized area” but directly connected to one that is.

The NYSDEC has published a list of New York State Municipalities that are automatically subject to Phase II Regulations.  There are fifteen in Dutchess County.

  • City of Beacon

  • Town of Beekman

  • Town of East Fishkill

  • Village of Fishkill

  • Town of Fishkill

  • Town of Hyde Park

  • Town of LaGrange

  • Town of Pawling

  • Village of Pawling

  • Town of Pleasant Valley

  • City of Poughkeepsie

  • Town of Poughkeepsie

  • Town of Wappinger

  • Village of Wappingers Falls

By March 10, 2003, these municipalities will be required to begin developing and implementing Phase II stormwater programs that meet six Minimum Control Measures. 

1. Public Education and Outreach

2. Public Participation and Involvement

3. Illicit Discharge Detection and Elimination

4. Construction Site Runoff Control

5. Post-Construction Stormwater management

6. Pollution Prevention and Good Housekeeping
