Phase II Construction Permit

  • If you are a developer, contractor, engineer, or municipal official, there is something you should know. 

 There are additional New York State permit requirements, mandated by the federal government, that regulate soil erosion and stormwater runoff from all construction sites that disturb one acre or more of ground surface.  The new Phase II Stormwater permit for General Construction Activities (SPDES Permit GP-02-01) took effect March 10, 2003.  The Permit affects ALL new construction and redevelopment of one acre or more of soil disturbance, whether it is residential, commercial, industrial, government-operated facilities, agriculture, or any other type of project.

 This law applies regardless of whether or not the activity occurs within a regulated MS4

 Construction sites required to obtain permit coverage under this new rule include:

  • Individual sites with a total soil disturbance of one acre or more, OR
  • Any multiple-lot project with a combined soil disturbance of one acre or more.

What exactly do I need to do?

 Here are the requirements for various possible situations:

 A.  My construction project will disturb more than one acre of soil surface, and involves:

  • Building a single-family home on a single lot OR
  • Building a residential subdivision of less than five acres disturbance

 B.  My construction project involves:

  • Disturbance of one or more acres and construction of any type of project other than single-family residences, (such as an apartment complex, condominiums) or commercial, office or industrial buildings
  • Disturbance of five or more acres of single-family residential

 C.  My construction project involves:

  • Performing work in a watershed for which a TMDL (Total Maximum Daily Load)  has been developed; OR
  • Discharging to an impaired waterbody on NYSDEC’s 303(d) list
